Section 69
Formation and functions of administrative courts, duties

(1) An administrative court shall be constituted as prescribed under the chairmanship of a person who is or has been or has qualified to be a judge of the High Court to hear appeals against the order of departmental punishment given by the officer entitled to order departmental punishment.
(1A) Notwithstanding anything written in sub-section (1), at the time of commencement of this section, if an appeal against the order of punishment as per clause (a) of section 59 has been registered with an officer and is yet to be disposed of, such appeal which has been registered with the officer, shall be disposed of by the same officer. .
(2) The decision made by the Administrative Court shall be final.
(3) In relation to a civil servant, after the appeal has been finalised, according to this section, if his service is reinstated as a result, if he does not appear within three months from the date of receiving the notice of such decision, then his employment will not be terminated.
(4) Other duties and duties of the administrative court and the procedure to be adopted by the court while exercising its jurisdiction or performing its other duties shall be as prescribed.
(5) The appellant may, if he wishes, sit on the date by himself or by his heirs and have the arguments presented by a legal practitioner.
